BCCLA v.The Ministry of Public Safety and Solicitor General

This submission is made pursuant to an Inquiry under Part 5 of the Freedom of Information and Protection of Privacy Act, R.S.B.C. 1996, c. 165 as amended (“FIPPA”), pursuant to a request for a review of the decision of the Public Body to refuse to disclose records related to background material for a report written by Josiah Wood on the police complaint process under the Police Act (the “Audit Records”).

The Inquiry arises from the Public Body’s refusal to disclose the Audit Records to the Applicant pursuant to s. 66.1 of the Police Act, R.S.B.C. 1996, c. 367 as amended. The Applicant submits that the Public Body’s refusal to disclose the Audit Records by application of s. 66.1 of the Police Act is incorrect and that the Commissioner should order the Public Body to release the records.
