In the fall of 2012 the Supreme Court of Canada’s decision in the Mabior case created a new legal test for disclosure of HIV to sexual partners. As a result, there are few situations in which disclosure of HIV to a sexual partner is not a legal requirement and failure to disclose can mean prosecution for sexual assault. This situation has serious implications not only for people living with HIV, but for service providers and public health initiatives, including promotion of HIV testing. This public talk explains the new laws and talks about the policy and legal developments one year into the Mabior era.
